It is expected that the terms and conditions be read and understood and that the signing authority has the legal right to sign and agree to all of the set out and conditions

The Contractor

1. Hereby agrees that all material used in the construction earth loop shall be of new materials.

2. The Contractor shall furnish all machinery, tools and Labour to complete the contract in a workmanlike manner. Agrees to carry all the necessary insurance against accident or injury to employees of the contractor, also reserves the right to leave the area of operations, if the operator deems it to be for the safety and the best interests of all concerned.

3. Agrees to drill to a predetermined depth for the length of the geothermal loop. Purchaser to be present at the time of the bore hole measured and if not present to accept the Contractors word of depth, and this measurement to be final.

The Purchaser

1. Hereby agrees to grant the drilling contractor and employees full right of access and agrees to said land to perform this contract, and shall not hold the contractor liable for damage to landscaping, lawns, or property of any kind.
2. Hereby permits the drilling contractor to dump all cuttings, water and debris around the site.
3. Hereby agrees that all material and equipment including casing, shall remain the property of the drilling contractor until such time as payment has been made in full, and in default in payment the Contractor or his employees may enter the premises without notice and remove there from all equipment and materials
4. Hereby agrees that during bore hole construction, should a flowing well occur, all costs incurred in attempt to bring the well under control, or damage to any property as a result from said flowing well will be the sole responsibility of the owner.
5. Shall have all locates completed 2 weeks prior to the start date of drilling. Any utilities hit will be the responsibility of the purchaser.
